When I was in Vietnam in the 1960s, it never occurred to me that I would be publishing this sad statement.

$afepro has received reports from across the country of MSHA inspectors showing up at "0 citation" sites and other low citation sites and announcing that they are there on "orders" to "teach" them a lesson and to bring an end to the site's "0 citation" inspections! This has resulted in the M/NM Industry spending critical money to overturn illegitimately issued false citations. We will publish no new "0 citation" success stories on our website until the "unconstitutional and illicit enforcement on the part of the agency" is stopped! It can be remedied by the present MSHA leadership, the Senate Health, Education, and Labor Committee, the House Education and Labor Committee, the Administration, or further economic erosion.

However, $afepro urges each Mine and Quarry to continue its 0 injury-0 citation initiative! The costs of injuries, of phony fines and unnecessary abatements are crippling in this economy.

Please continue to provide the safe jobs that are supporting our Industry's families! Though we cannot post them for fear that it will make you an MSHA target, we do want to hear about your successes.
